Terms & Conditions

These Terms & Conditions ('Terms') govern the provision of cosmetic and aesthetic health services by Beautiqué Cosmetic Clinic ('Beautiqué', 'we', 'us', 'our'), located in Broadbeach, Gold Coast, Queensland, Australia. By booking, attending or undergoing any consultation or treatment with us, you ('you', 'the Client') acknowledge that you have read, understood and accepted these Terms.
1. Eligibility and clinical suitability
All Clients must be 18 years of age or older. We reserve the absolute right to decline, postpone or modify any consultation or treatment if, in the professional opinion of our registered cosmetic nurse or prescribing practitioner, the treatment is not clinically appropriate, safe or in your best interests.
You must disclose, accurately and completely, all relevant medical history, medications, allergies, prior cosmetic treatments, pregnancy or breastfeeding status, and any other information requested. Failure to disclose accurate information may compromise your safety and outcomes, and releases Beautiqué from liability for any resulting complications.
2. Consultations and informed consent
All clinical services require a consultation with a qualified practitioner and, where required by law, a valid prescription. Written, informed consent must be provided prior to each treatment, confirming you understand the nature, risks, expected outcomes, potential complications and available alternatives.
Treatment cannot proceed without signed consent. You may withdraw consent at any time prior to treatment commencing.
3. Bookings, deposits and cancellations
- A non-refundable deposit may be required to secure your appointment. Deposits are credited to the treatment cost on the day.
- We require a minimum of 48 hours' notice to reschedule or cancel an appointment. Cancellations or reschedules within 48 hours forfeit the deposit in full.
- 'No-shows' (failure to attend without notice) forfeit the deposit and may require pre-payment in full for any future bookings.
- Arriving more than 15 minutes late may result in your appointment being shortened or rescheduled at our discretion, with deposit forfeited.
4. Payment
Full payment is required on the day of treatment. We accept major credit cards, EFTPOS and other approved payment methods. Prices listed on our website, social media or marketing materials are a guide only and may change without notice. The final price is confirmed at consultation and is subject to your individual treatment plan.
5. No refunds policy
All payments for treatments, packages, prepaid courses, products and deposits are strictly non-refundable. This includes circumstances where:
- you change your mind before or after treatment;
- results vary from your personal expectations;
- results are not yet visible during the expected onset window;
- you are unable to attend remaining sessions of a course or package; or
- you are deemed clinically unsuitable for further treatment after commencement.
Cosmetic treatments are a clinical service rendered in real time and cannot be returned, undone or re-stocked. Nothing in this clause excludes any consumer guarantee that cannot be lawfully excluded under the Australian Consumer Law.
6. Packages and prepaid courses
Packages and prepaid treatment courses must be used within 12 months of purchase unless otherwise specified in writing. Unused sessions after expiry are forfeited and are non-refundable, non-transferable and non-exchangeable for cash, products or other services.
7. Results, expectations and individual variation
Cosmetic treatments are inherently individual. While we use TGA-approved products and evidence-based techniques, no specific result, longevity, symmetry or outcome is guaranteed. Factors including (but not limited to) anatomy, skin type, lifestyle, age, hormones, medication, metabolism and aftercare compliance influence results.
Before-and-after images on our website and social media depict actual Client outcomes but do not represent a guaranteed result for any other person.
8. Quality assurance and complimentary review
Where clinically appropriate, we offer a complimentary review approximately 2 weeks post-treatment. Any clinically indicated adjustment is at the sole discretion of the treating practitioner and may incur additional product charges.
Requests for review or adjustment must be raised within 14 days of the original treatment. Requests outside this window will be treated as a new appointment at standard pricing.
9. Aftercare and Client responsibilities
You agree to follow all aftercare advice provided in writing or verbally by your practitioner, including:
- avoiding strenuous exercise, alcohol, heat exposure, facials, massage or makeup as directed;
- refraining from manipulating, massaging or applying pressure to the treated area;
- attending recommended follow-up appointments; and
- promptly reporting any unusual or adverse reaction.
Failure to comply with aftercare instructions may compromise your results, increase the risk of complications, and releases Beautiqué from liability for any adverse outcome attributable to non-compliance. Additional or corrective treatments required due to non-compliance are at the Client's expense.
10. Risks, complications and adverse reactions
Cosmetic medical procedures carry inherent risks, including but not limited to: bruising, swelling, redness, tenderness, asymmetry, lumps, infection, allergic reaction, vascular occlusion, scarring, pigmentation changes and, in rare cases, more serious complications. These risks are explained in detail during consultation and within the consent form.
By signing the consent form and proceeding with treatment, you acknowledge that you have been informed of and accept these risks.
11. Photography and records
Clinical photographs are taken before and after treatment as part of your medical record and for quality assurance. Use of images for marketing, education or social media requires your separate written consent (see our Privacy Policy).
12. Behaviour and Clinic environment
We reserve the right to refuse service, end an appointment or remove any person from the premises who is intoxicated, aggressive, abusive, disruptive or otherwise compromising the safety or comfort of staff or other Clients. Deposits and fees paid are forfeited in such circumstances.
13. Limitation of liability
To the maximum extent permitted by law:
- Beautiqué Cosmetic Clinic, its owners, directors, employees, contractors and agents are not liable for any indirect, incidental, special or consequential loss or damage arising out of or in connection with any treatment, service, product, advice or information provided;
- our total aggregate liability to you for any claim arising out of or in connection with any treatment is limited, at our sole discretion, to the resupply of the relevant service or the cost of having that service resupplied;
- we are not liable for any loss or damage caused or contributed to by your failure to disclose accurate medical information, your non-compliance with aftercare, or your failure to attend follow-up appointments; and
- we are not liable for outcomes that fall within normal clinical variation or for results that differ from your personal expectations.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot be lawfully excluded.
14. Indemnity
You indemnify and hold harmless Beautiqué Cosmetic Clinic and its personnel from and against all claims, losses, damages, costs and expenses (including legal costs on a full indemnity basis) arising from: (a) any breach of these Terms by you; (b) any failure to disclose accurate medical information; or (c) any non-compliance with aftercare or clinical instructions.
15. Privacy
Your personal and health information is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
16. Complaints and dispute resolution
We are committed to resolving any concerns promptly and professionally. Please raise any complaint directly with us in the first instance via info@beautiquecosmeticclinic.com.au. If a complaint cannot be resolved internally, you may contact the Office of the Health Ombudsman (Queensland) or the relevant regulator (AHPRA).
17. Severability
If any provision of these Terms is held to be invalid, illegal or unenforceable, the remaining provisions continue in full force and effect.
18. Variation
We may update these Terms from time to time. The version published on our website at the time of your booking applies to that booking.
19. Governing law and jurisdiction
These Terms are governed by the laws of the State of Queensland, Australia. Each party submits to the exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from them.
